We are a commune of inquiring, skeptical, politically centrist, capitalist, anglophile, traditionalist New England Yankee humans, humanoids, and animals with many interests beyond and above politics. Each of us has had a high-school education (or GED), but all had ADD so didn't pay attention very well, especially the dogs. Each one of us does "try my best to be just like I am," and none of us enjoys working for others, including for Maggie, from whom we receive neither a nickel nor a dime. Freedom from nags, cranks, government, do-gooders, control-freaks and idiots is all that we ask for.
It's disappointing. I can't tell what "race" anybody is anymore. Maybe they will need to reintroduce skin-tone meters and eye-slant meters. It's all too stupid for words. Remember when Sharpton accused Obama of being "too white" to represent black people? I mean, if Obama is "black," then he's "white."
[T]he Court held that the Fifth Circuit Court of Appeals applied the incorrect standard. Thus, it sent the case back for further review under the appropriate standard. Under the appropriate standard... a university must prove that the means it chooses to attain racial diversity are narrowly tailored to that goal. This means that a reviewing court must verify that it is “necessary” for a university to use race to achieve the educational benefits of diversity.
The SCOTUS has failed once again to cease digging the deep legal hole it created for itself with its past opinions on affirmative action. Maybe, in the hopeful words of former Justice Sandra Day O'Connor, it is time for AA to simply be ruled for what it obviously is to everyone but those black robed folks in DC who find it hard to say "we're sorry" for having gotten it so terribly wrong for so long: unconstitutional.
The Supreme Court has turned into the chicken shit brigade. It created a race problem when it approved affirmative action, ala quotas, based on the 65 civil rights act. The one in which Hubert Humphrey said he would eat every page of the 65 law if you could find any basis for quotas. Humphrey evidently died of paper compaction. And the court to too damn cowardly to admit a mistake was made in mandating unequal treatment under the law. They screwed the Constitution and they know it.
The colleges and the government should be race blind. While the illusion of diversity may seem worthwhile it is little more then the KKK in black robes. In order to hand someone something they didn't earn you have to take it from someone who did earn it. The correct solution to this issue would be to have organizations like the NAACP and La Raza spend their time and money identifing black and hispanic students who have the ability to succeed and to tutor and mentor these students until they can legitimately pass the entrance exams and succeed in college. This would solve two problems: 1. It would appropriately increase the numbers of under-represented minorities in colleges and 2. It would give the racist organizations like NAACP and La Raza a legitimate purpose. It is not the job of the government and quasi-government organizations like state colleges to discriminate even when they puff that discrimination up in flowery names like diversity.
