Judiciary overreach. The courts are supposed to rule on constitutional issues and issues of law not politics. The judges who are being used to stop the Trump administration from administering are biased and they are out of their lane. The president is the ultimate authority on who works in the administration not the courts. These activists judges should be impeached.
Also it is the MSM's job to tell the whole story about this. This is a political action but they fail to tell us who is behind it. Which lawyers? Which law firms? Whose funding it? The 16 state AG's who filed a lawsuit were funded by Soros. The states should impeach them. We need more sunshine not less. OneGuy: Judiciary overreach. The judge's order was based on issues of law, the Administrative Procedure Act, among others. The order is only in effect for a few days so that a hearing can be held. OneGuy: The president is the ultimate authority on who works in the administration not the courts. That is not correct. The most obvious example is that the Senate has to power of advice and consent over officers of the executive branch. While some powers are strictly the President's, Congress controls the purse strings, so it can attach restrictions on how money is spent, including the creation of federal agencies and the civil service. The Administration has the right to set priorities, so that they control funds that are already allocated by Congress. They can choose to NOT spend funds that Congress authorizes.

If Congress could pass a law requiring the expenditure of funds, and the President could simply ignore the law, then Congress would no longer have power of the purse. The courts have repeatedly held that the President can’t just refuse to spend funds as directed by Congress. For instance, Congress had passed an appropriation over President Nixon’s veto, then Nixon impounded the funds, but the courts found he had no such authority, and he was required to “Take Care that the law be faithfully executed.” See Train v. City of New York. On the other hand, Congress can and does delegate authority to the President to withhold funds in certain circumstances. That requires examining the statute and the case history. Academic Medical Research. This is the one DOGE area I actually am concerned about. This seems like a real baby/bathwater risk. It is similar to my feelings about Big Pharma - sure there's a lot of corruption there, but they do get some very good stuff done. Go after them last.
A small, more restrained, less expensive, less powerful government is not a cafeteria line. Nobody gets to get rid of only the stuff they don't like or gets to keep everything they do like. Buckle up butter cup.
I'll add, the argument that they do some good stuff is not relevant. The question is the cost per unit of innovation that is worthwhile, and how worthwhile it is. Something tells me that letting universities use other people's money to do stuff is not the most efficient way to do it. It might be helpful to mankind to abolish 'gain-of-function' research.
The problem isn't academic research. The problem is the federal government paying for it ESPECIALLY in secret.

Because there is evidence Musk and the Trump Administration are breaking the law, such as by using access to stop payments contrary to statute, which would violate the Separation of Powers doctrine and the Take Care clause of the U.S. Constitution. In addition, laws and regulations protect sensitive personal and financial information from improper disclosure, and govern who and why authorities can gain access. And the change to the policy granting Musk access isn't consistent with the Administrative Procedure Act. As noted above, the injunction is just temporary until a hearing on the merits can be held. |
