The Althouse Law blog has a thread on the Charles Cooke column whining about Trump. Charles Cooke is bored with Trump.
There are several good responses, a couple of favorites: "Blogger Amadeus 48 said... Charlie Cooke is a proud naturalized citizen of the USA. He is as entitled to be bored by and of Donald Trump as the rest of us are. Falling right into Charlie's stereotype, I will never forgive the FBI, DOJ, and Merrick Garland personally for forcing me to support Trump for president in 2024. Why did they do it? He's too old. He's too erratic. He is coming back, and this time he is mad. I am too old for this. Do I have to spend the rest of my life listening to the tedious trio, Trump, Biden, and Hillary? Think about those Boomer presidents: Clinton, Bush 43, Obama, and Trump. Each ghastly in his own way. And Biden isn't even a Boomer. He is too old. It is strange that the very same politicians and pundits who have been preaching conservative ideals but never seem to get anything done are so angry with Trump when he accomplished so many of these conservative goals. The intelligence agencies didn't do it they stone walled Trump until after Jan 20th. But these papers implicate the senior officials in intelligence and FBI in their attempted coup of Trump. They had to get these papers out of fear that they would be released someday and it would put them in jail. In other words its a coverup.
IdahoBob: The raid on Trumps house was to get papers that Trump had declassified 2 1/2 years ago and then commanded his administration to release.
How do you know this? In any case, it would be easy to prove. Trump just has to provide his order to declassify the documents. While he's at it, he could also release the search warrant. But, for some reason, he hasn't. Trump ordered all Crossfire Hurricane documents to be declassified while he was still president. As of February this year, the DOJ has refused to release those documents to senators on the Judiciary Cmte.
Trump does not have the warrant to release. That's why lawyers for Trump asked for and a Federal judge ordered the release of the warrant. mudbug: Trump ordered all Crossfire Hurricane documents to be declassified while he was still president.
The Memorandum on Declassification, signed at the very end of Trump's administration, allows for a number of redactions. The Memorandum ordered the Attorney General to made the redactions and release the remaining records, but he didn't. If he has them, Trump could release the documents, but he hasn't. In any case, the new president can make his own determination of what should be released. https://trumpwhitehouse.archives.gov/presidential-actions/memorandum-declassification-certain-materials-related-fbis-crossfire-hurricane-investigation/ mudbug: That's why lawyers for Trump asked for and a Federal judge ordered the release of the warrant. Uh, no. That's not what the report by Citizens Free Press says. It says the Department of Justice has to respond to the request, not that they have to unseal the search warrant. Nor does it say that Trump doesn't already have the warrant, which Trump could release anytime he wants. https://citizenfreepress.com/breaking/tom-fitton-strikes-again/ RJP: Is there anyone on earth naive enough to believe the DOJ on this? It's called accountability. The Department of Justice has asked the court to unseal the warrant. That will answer some questions, and probably raise others. The DOJ responded to the judge's order which was requested of the judge by Tom Fitten. The DOJ would be world class idiots to appeal the judge's order to a higher court.

That makes no sense. The order was just to respond, not to unseal the warrant. Only the court can unseal the warrant.

Yes, they have to respond. The Department of Justice could have argued against unsealing the warrant, due to an ongoing investigation, or because there could be national security issues involved. They chose not to do so, but have moved to unseal the warrant. It would be moot if Trump just released the warrant.

The only thing being considered for unsealing are the documents already provided to Trump: the search warrant, and the inventory. The vast majority of investigative information, including how the FBI found out about the files would not be made public.

You are assuming that the FBI was looking for files but there is no evidence of what they were looking for as they only acknowledge the warrant and the property taken. Not a simgle word about what they were looking for or who or what provided that information. This could easily be nothing more than a snooping venture just as all the FISA warrants were nothing more than snooping ventures.

General warrants are not allowed under Common Law or under the U.S. Constitution. A search warrant application must provide the court probable cause that a crime has occurred (though may not indicate the subject of the investigation), a place specified, that the place will have evidence of the crime, the particularity of the items to be seized as evidence, the warrant shown to the person whose property is to be searched, and the magistrate named to whom the warrant will be returned. (If something is found in plain view during the search that is also evidence but not specified, that can be seized, as well. See Horton v. California) Court records show that Trump was provided a copy of the warrant and the inventory of items seized. The warrant and inventory will probably be unsealed in the near future.

You had claimed:
indyjonesouthere: This could easily be nothing more than a snooping venture But general warrants are not allowed, and wouldn't be approved by the courts. Besides the requirements detailed above, there is a recency requirement. The information about the specific evidence and specific place has to recent. That's why the warrant was probably based on insider information.

Apparently a federal judge believed FBI sworn attestations. But there will be accountability. As for indicting Trump, proving intent would be very difficult, so they are probably just glad to have retrieved the documents.

Funny how the warrant never mentions that vital "top secret nuclear information". Instead, it asks for anything marked classified, anything defense related and "Any government and/or Presidential Records created between January 20, 2017, and January 20, 2021;". Rather broad, wouldn't you say? And hardly indicative of any specific crime, but very much like a fishing expedition.

The warrant encompasses top secret documents, other classified documents, along with presidential records that are supposed to be under the legal and physical custody of the National Archives and Records Administration. RJP: very much like a fishing expedition. The warrant specifies things that Trump has no legal right to possess. After having subpoenaed the documents months ago, and apparently having current inside information about the whereabouts of the documents, it is entirely appropriate that a search warrant was issued.

Here's the exact text from the warrant:
c. Any government and/or Presidential Records created between January 20, 2017, and January 20, 2021; (You can read the warrant and inventory, along with commentary by a lawyer a lot smarter than me at the Legal Insurrection blog: Court Unseals Trump Search Warrant and Inventory of Items Seized ) But, according to Zach, that's not broad at all, it's very specific, very limited in scope, not a fishing expedition at all and why on earth would you think that. But then he has to say that, as earlier today he had stated that General Warrants are not allowed. Warrants must include, according to Zach, "the particularity of the items to be seized as evidence" and that particularity is completely missing from this warrant. Zach also skips over the fact that he was quite sure there was "top secret nuclear information" (don't tell me you weren't) in Trump's possession. Funny how the warrant (or the inventory of confiscated documents) didn't mention those docs, eh, Zach? I'm sure none of this matters. Zach will be distracted by the next enticing morsel the media throws in front of him and will forget any of this happened.

RJP: that's not broad at all
If the warrant just said "documents," then it would be overbroad. The question the court will ask is whether the officers engaged in the search would be authorized to seize only those documents that would be evidence of the crime under investigation. In this case, "government and/or Presidential Records" are contraband and prima facie evidence of possessing "government and/or Presidential Records." RJP: the fact that he was quite sure there was "top secret nuclear information We never made that claim. In any case, Trump can certainly contest the warrant in court. After all, the particularity requirement is right there in the U.S. Constitution. How do you think that will go?
