Ace is confused by The Science

THE WEEK IN PICTURES: WOMEN’S QUESTION EDITION

It has never been a confusing issue for me, but I am an expert. In my education I majored in it.

One thing had me wondering. If the nominated Justice Jackson is not sure what a woman is, how can she be comfortable being the first black woman Justice? Is she sure what she is?

That is not correct. For example, some people with androgen insensitivity can have XY chromosomes, but have a mixture of male and female traits, including breasts or female genitalia. That doesn't even touch on the issue of gender identity.

Kind of like a two headed calf or something. I've seen a two headed calf and it never occurred to me that it was normal or should be encouraged. Kind of a freak of nature not something to be looked up to as a goal. I mean... that would be stupid, right?

Someone can be XX with male genitalia, such as with de la Chapelle syndrome. Someone can be XX with female genitalia, but have high testosterone levels leading to male characteristics, including identification as male. Another person with XX and female genitalia may also have high testosterone levels, but still identify as female. People are like that.

Is it black or white?

Your question entails a definitional false dichotomy. We responded based on objective observation. Someone who is XX and has female genitalia can still exhibit characteristics of being male. They can even have a penis! The identification of biological sex can be uncertain, with about one in a thousand births exhibiting ambiguous genitalia.

Sorry, but the world doesn't only exhibit blacks and whites, but grays and even colors.

Good question. How gender is defined and its relation to law would be something a court would require expert opinion concerning.

Nor is the question new. For instance, gender is important in Jewish law, and the Mishnah discusses legal questions concerning people who are intersex.

Will biologists start giving out affidavits to individuals certifying they are a man or woman or something else?
Biology departments will be flooded with students wanting an identification or to become experts so they can be checking nude bodies.
Congress will now pass a law describing men and women with pictures.
The Supreme Court will take up Title IX cases to assign people to a sport.
Supreme Court nominees of the future must be inspected to determine if they are a man or woman.
Current Supreme Court nominee rules women do not exist without expert proof.

Biden pledged he would put a Black WOMAN on the Supreme Court.

But if even his nominee cannot discern who is -or is not- a woman, then, perhaps, "she" is not a Woman! How can Biden be certain he's nominated a Black WOMAN? Perhaps he's made an error and the nominee is a Man! How to be sure?
As Zachriel pointed out, just because nominee appears to have breasts, and (perhaps) a vagina, a XX genetic profile, and other female characteristics, gives us no guarantee that that person is a Woman!![/] There is, apparently, no good & consistent definition.

There may also be a question about whether the nominee is Black! Can Biden just use some genetic markers to define Black_ness? It would seem [b]not; since such data is not sufficient evidence for defining Woman_ness! Then consider the case of Rachel Doležal. once a Chapter President of the NAACP. Rachel identified as Black, but if that alone were sufficient to be Black, then there was no reason for Rachel to be scourged from the NAACP for being White?

Apparently, based on Zachriel's, and other's, definitions (or lack thereof), anyone can be most anything.

Dolezal can adopt aspects of Black culture, but being Black is a matter of ancestry. Gender is more complex, and there can be significant ambiguity in sexual development and gender identity.

Then QED: By your definition, all those Caucasian-looking people whose ancestors moved to the southern tip of Africa over 200 years ago must be Black too.

How does "little doubt" identify Jackson as a woman?
Does Jackson identify as a woman?
Says who? Where's the video, or other proof, where Jackson says that?

Those are all heritable traits. However, not everyone with kinky hair, dark skin, or sickle cell anemia has sub-Saharan African ancestry; nor does everyone of African ancestry have those traits.

Yes. Her gender was included in the official White House announcement of her nomination to the Supreme Court.
