Brooklyn Supreme Court Justice Edward Pincus let Chen off with probation—for murder—after an anthropologist testified that, in Chinese culture, the shame of a man being cuckolded justified murder…. The female head of the Asian-American Defense and Education Fund, Margaret Fung, applauded Chen’s light sentence, saying that a harsher penalty would “promote the idea that when people come to America they have to give up their own way of doing things. This is an idea we cannot support.”

So - Muslims should be able to kill the daughters who "dishonor" them or mutilate their genitals, or whatever?

This decision is seriously bent.

This decision is appalling, but it's also from 1989. That's no excuse, but if this is the only example we can find in the last 25 years, I'm feeling better and not worse about things.

Wait a minute. I'm fairly certain that in the 1950s you could have found an anthropologist to testify that in the Jim Crow culture, the shame of a white woman having to eat next to a black man justified murder.

As an aside, I've been trying to google up some of the old segregationist discussions of the differences between whites and blacks to put alongside the "white culture" conference materials. Such thing seem to have been effectively purged from the internet.

No doubt just like justifications that mirror the statement from Brooklyn today.

1. You can find this 1910 quote from H.L. Mencken at Wikiquote:

"I admit freely enough that, by careful breeding, supervision of environment and education, extending over many generations, it might be possible to make an appreciable improvement in the stock of the American Negro, for example, but I must maintain that this enterprise would be a ridiculous waste of energy, for there is a high-caste white stock ready at hand, and it is inconceivable that the Negro stock, however carefully it might be nurtured, could ever even remotely approach it. 2. A joke among white Southerners in the 1950s:

An African American ordered a drink at a cheap, segregated bar full of poor white folks.

The white bartender went to the white owner. "What do I do?" the bartender asked.

"Tell him drinks are $10," the owner said.

The bartender did. The African American man bought a drink and left.

The next day the African American man returned and ordered another drink.

"What do I do now?" the bartender asked the owner.

"Tell him drinks are now $20," the owner said.

The bartender did. The African American man bought a drink and left.

"What do I do if he comes back?" the bartender asked the owner.

"Tell him drinks are still $20," the owner replied, looking at the poor white customers in the bar. "And asked him if he wants you to clear this white trash out of here."

That's an OT principle (Asian culture as well, I understand), one that was brought over to the colonies by at least a few of the English settlers.

So I've never really had a problem with it. In fact, I wondered how it fell out of fashion.

you should really blame the government prosecutors for being lazy or inept.

I explained to a district attorney that my vietnamese client shouldn't be blamed for leaving chop stick stripes on his girlfriend's daughter's face because of some cultural bullshit that I'd made up just for a plea negotiation conference. she bought it because she was stupid or lazy and the judge agreed to some trivial sentence. if that had been my kid I'd have gutted that little shi'ite. if the DA had called my stone cold bluff the asshat would have done prison time.

another instance: the government was considering moving forward on a first degree murder charge against the client, who actually did murder the victim in a first degree way. the client's idea was to offer to disclose the location of the missing body in return for a plea to second degree murder. before we could make this offer, the government -- because the DA was stupid or lazy -- offered voluntary manslaughter, a better offer than 2d murder.

I thought it was still common law in Texas for justifiable homicide to kill one's wife and her lover if caught in the act.

Growing up in the Deep South, one of my classmates, the daughter of the county sheriff, was deeply embarassed when her father was shot while in bed with his deputy's wife by his deputy. Non-fatal, of course but wounding to all.

Shaw v. State explains it. apparently, this was actually in the Texas statutes until repealed in 1974.

so you're telling me that he shot the sheriff ...
