I do not defend Polanski, for the tenth time. ` Ok, I was in a vigorous disagreement with a liberal leaning friend over Mr. Polanski. My take "He raped a 13yo girl". His take was Whoopi's take "It wasn't rape-rape." In there was not the "rape violence" classically associated with the word "rape". My friend's defense of the perp was (boils down to) he was 'seduced' by a girl who said she was older, looked older, and acted older (I have seen pictures of her in both states.... some of which I would say she looks like a typical 12yo...and others that would lead one to believe she was much older. Aside: I have a niece, when she was 13, was very well developed (very tall at 5'10 and well endowed). My sister and her husband were very much aware of the bees/honey thing. They made it a point of making sure that any supervised activity where she had a male escort, that the male KNEW she was 13. A couple of them related that they though she was much older. It does happen.)
All that led into other discussions but the one question I had no real good answer for was "When did the laws for 'age of consent' come into being?" I attended a family seminar some years ago, where as one of the final exercise, he had everyone there line up by age. After some jockeying for position he started separating age groups out with 50 years ago.... this age group did that. prior to 1940, this age group did this. prior to 1900 this age group could do that. He asked how many women got married before 20? Before 18? By 16? Surprisingly (to me) there were at least two women married by 16, one was married at 15..... things now that would have the male in jail for statutory rape that in the early part of the 20th century was perfectly acceptable to society. In H.S. (late 1960's) the statement then was "16'll get you 20, 15'll get you life" warning all us hormonal young studs away from pheromone saturate females and doing what nature was driving us to. But even then I remember reading some western history where farm girls were marrying at 14 to some much older guy (16) and starting out a new home. Even Paul Harvey was celebrating his married couple of the day being married 75years with all these children/grandchildren/great-greats and all that. And you know that couldn't happen today because it'd be statutory rape (if he was lucky) and not "child molestation and sex with an underage female" with mandatory 20 year prison and continuous punishment as a sex offender for the rest of his life. Again, none of that to condone or excuse a middle aged man from drugging an underage girl for rape. But just to ask the question of when "age of consent" laws went from "community/family standard" to this "here is the line where one day the female is a child/ the next day+1 she can go screw the world and we don't care". Oh, BTW. My liberal friend remains unconvinced that Roman Polanski "raped" her. He said "she asked for it"... the classic defense of a rapist toward an immodestly dressed female. Howdy Joe
"Age of consent" as a statutory item is pretty old, though I don't know the first references. Michael Crichton refers to England's age of consent as 12 around 1857. "Statutory rape" has always included a line roughly "not his wife". If a 16-year-old married a 14-year-old in 1876, that would have obviated any statutory rape charge. For that matter, in something a lot more than theory, a man of 50 could marry a 15-year-old quite legally. Re Mayor Bloomie and the surveillance system: a surveillance system is only a tool for observation. The area involved is at high risk for ordinary crime and for terrorism.
But it is telling that Bloomie used such a phrase. Of course people may go anywhere they like and take any pictures they like outside of a marked restricted area. re Gub'ment money
What happens when the public till goes dry. Can we hope that ALL of the incumbent employees will simply leave so that we may start over again. The time of 20 years and out, reset start a new 20 and carry on must find an end. It will hurt (like GE, GM, Chrysler Non-union folks) etc......... |
