For Brett Kavanaugh: A long strange trip

Strangest thing about it is that he is a relatively non-partisan, moderate judge. He is no Scalia, not a ideologue. He was not my top choice. Trump's next choice, the lady, will be a tough nut to crack because she is not a drunk gang rapist.

Yes, but do you think she is willing to go through the non-stop harassment, threats and attempts to ruin her life that Kavanaugh went through?

There really needs to be a full-out investigation of what the Democrats did with Kavanaugh. It crossed the line into criminal behavior by the rats and their allies, and if some people aren't prosecuted and put in prison, they will do it again. Also warranted (after the midterms) would be the censure of Schumer, Feinstein and others, and removal from office if the investigation finds they actively leaked information and coordinated these attacks.

The good thing is I think the GOP senators now realize these people are a threat to our country and have finally dropped the gloves and are coming out swinging against them.

Agreed, but with one quibble: rats have a better sense of fair play than that. (N.B. Dr. Peterson cited the study, but I don't remember the citation.)

Agreed. This was an offensive and unwarranted attack on the rodent population. If I was of the leftie persuasion, I'd say that Jim should die painfully without trial and all his successors born and yet unborn along with him, but I'm not, so I won't. As for abortionist liars...

I was reflecting this morning what kind of arguments we'd be hearing from the Leftists in a world in which, for whatever reason, the orthodoxy demanded that Leftists oppose abortion while Conservatives agitated for unrestricted abortion on demand right up to a nanosecond before delivery. I'm pretty sure it would turn out that the Conservatives' position was simply one more demonstration of their callous disregard for the lives of otherkin, not to mention an assault on the sacred bodies of the Allmothers.

You don't have to reflect on a counterfactual. There are many on the left who oppose abortion, such as those on the Christian left who support life from conception to natural death.

We shouldn't forget that K was one of the drafters of the Starr report, the impeachment referral to the house from the independent counsel's office. That he helped put together all that stuff against Bill Clinton and served in a Bush administration is enough for many to consider him hopelessly partisan, even if that is never reflected in his work as a judge.

On Thursday I was listening to the NPR "Here and Now" program, and they were speaking of K's senate testimony. NBC senior politics editor Beth Fouhy said of K that "He declared himself a political partisan – he got up and said in front of that committee and in front of the nation that he would take revenge on the democrats if he were confirmed onto the court".

It's taken me several days of intermittent research to nail down where she could have got the impression that he said that, but it appears to come from the September 27 hearing, where he said:

"This is a circus. The consequences will extend long past my nomination. The consequences will be with us for decades. This grotesque and coordinated character assassination will dissuade competent and good people of all political persuasions, from serving our country.

"And as we all know, in the United States political system of the early 2000s, what goes around comes around. I am an optimistic guy. I always try to be on the sunrise side of the mountain, to be optimistic about the day that is coming. But today, I have to say that I fear for the future.

Jonathan Chait of New York Magazine heard "what goes around comes around" not as a prediction of inevitable harms resulting from character assassination becoming a "normal" part of the appointment/confirmation process, but as a revenge threat:

"Perhaps the most chilling line in Kavanaugh's speech was, 'what goes around, comes around.' . . . Here was a man apparently threatening revenge on his political enemies, and asking for a lifetime appointment with supreme power of judicial review with which to do it."

Sen. Coons echoed that interpretation on Twitter, so we have a NPR, NBC, New York Magazine, and a Senator all claiming to have heard in that line a threat of partisan retaliation.

I think that interpretation is bonkers, but there you go.

A high school acquaintance was on that point lately; it seems to be the point du jour. I think even K feared he'd allowed people to misinterpret him that way, hence his WSJ op-ed Friday. But what happened to "if you radicalize someone by intolerable treatment, his terrorism is on you not him?" OK, I know, I know, no one ever meant us to take that argument seriously when it came to a human being we expect grown-up moral behavior from.

I read the Starr report. It had the strange effect of making me feel sorry for Clinton. I still thought it was unacceptable to have sex (sorry, that's what it "is is") with a much younger employee, and unacceptable to lie about it under oath in a lawsuit over workplace sexual harassment, and it stopped being "private" when you did it in the office with an employee. I can't condone lying to cabinet members so they'll support the lie in public. But I no longer thought he was leaning on an employee for sex--at least in that situation--and I thought he was a pitiful guy with his youth running out and unable to say no to candy dangled in front of him, though he clearly was struggling with himself. It made him seem more human to me. So much for Kavanaugh as a minion of Inspector Javert.

We can all look to the important non-partisan work Kavanaugh did with Ken Starr by posing this question of great national importance to a sitting President: "If Monica Lewinksy says that on several occasions in the Oval Office area, you used your fingers to stimulate her vagina and bring her to orgasm, would she be lying?"

All they have to do, as to Kavanaugh, is have their speech writers create allegations from thin air that'll rile up their base of rabid leftist professional protestors, then find an actor or actress willing to step in and play the part of the harmless victim to a far right radical extremist who'll stop at nothing to get his or her way.

After the Kavanaugh debacle there is no reason for Republicans to conduct hearings for nominees of Republican Presidents. There's no requirement in the Constitution for the Senate to conduct hearings, and they were not conducted until the 1950s. The Democrats have demonstrated repeatedly that they are incapable of evaluating conservative judges in a fair and professional manner. The entire hearing process simply needs to be ended, at least for nominees by Republicans.

I would also argue that after the Kavanaugh debacle there's no reason for the Republican Senate ever to confirm another judge nominated by a Democrat president.

At first I wondered why Trump had nominated Kavanaugh before Barrett, but as usual, Trump out-trumped me.

For a brief moment in time, The Donald managed to unite the Rockefeller/Bush Republicans with his new brand of Constitutionalism. George W. spend much time correcting the miscalculations of DimDems trying to derail this very qualified candidate. Good show!

BTW, Blasey-Ford and her CIA/FBI/DNC cabal need to be jailed for abusing women who truly have been abused. That stage play triggered more than those highly-paid demonstrators.
